Makers House™ Ticket Policy
This Ticket Policy applies to any purchases on our site made on or after January 1, 2024. By purchasing a ticket on this website you are consenting to be bound by this ticket policy.
Your order is confirmed when we send you a confirmation, in the form of a confirmation email (“Order Confirmation”).
If you do not receive an Order Confirmation after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm you have placed a valid ticket purchase. Only you may be aware of any problems that may occur during the purchase process. We will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.
Tickets purchased on our Site are typically subject to, among other possible fees, a per-ticket service fee and shipping charges. Ticket processing and shipping fees are nonnegotiable and nonrefundable.
All sales are final and non-refundable.
Before purchasing tickets, carefully review your purchases and all event details.
You agree that you will not attempt to evade, avoid, or circumvent any refund prohibitions in any manner with regard to the tickets you purchased. Without limiting the generality of the foregoing, you will not contact us to seek a refund or exchange and you will not dispute or otherwise seek a “chargeback” from the company whose credit card or another method of payment you used to purchase tickets from the Site. Should you do so, your tickets are subject to immediate cancelation, and we may, in our sole discretion, refuse to honor pending and future ticket purchases made from all credit card accounts or online accounts on which such chargebacks have been made, and may prohibit future purchases from all persons in whose name the credit card accounts exist, and from any person who accesses any associated online account or credit card or who otherwise breaches this provision from using the Site.
Any credit card chargebacks will be fought with an immediate filing in small claims court against the ticket purchaser.
Ticket delivery method and event entry protocols are at the sole discretion of the Event Organizer and include but are not limited to; physical ticket required, digital ticket required, and no ticket required (name on the list at entry).
You agree to comply with all of the Event Organizer’s applicable rules, policies, terms, and conditions (“Event Organizer Rules”). The Event Organizer reserves the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language, or who fails to comply with Event Organizer Rules.
You consent to searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to the event without a refund or other compensation. Under certain facility rules, certain items may not be brought into the premises, including without limitation: firearms, alcohol, drugs, controlled substances, cameras, recording devices, laser pointers, strobe lights, irritants (e.g., artificial noisemakers), bundles, and containers.
If the event is postponed, rescheduled, or moved: your ticket(s) (including any additional add-ons or upgrades, such as parking) are still valid, and no further action is required. However, the Event Organizer will not approve refunds, the Event Organizer may approve a nonmonetary event credit if you are not available for the rescheduled event date. If the Event Organizer approves a future event credit, we will send you a notification explaining your options, and you may submit a request for credit redemption toward a future event of equal or lesser value. Alternatively, you may simply keep your ticket(s) to the postponed, rescheduled, or moved event. Credits are transferable upon written notification, are not redeemable for cash, and may not be combined with other promotions. Credits may not be applied to previously placed orders.
Your use of any Makers-House ticket during the 2023 calendar year and beyond is subject to these Terms (Terms"). By purchasing or using a ticket for an Event, you, on behalf of yourself and anyone on whose behalf you are purchasing a ticket, acknowledge having read these Supplemental Terms and the applicable ticket terms and agree to be bound by them.
Due to the uncertainty related to the covid-19 pandemic, you acknowledge that you are purchasing a ticket in the current covid-19 climate and take full responsibility for your purchase and acknowledge any risk associated with such purchase and attending of the Event. By using Event tickets, you acknowledge and agree that your attendance at the Event On behalf of yourself and your Related Persons (defined below), you further hereby release (and covenant not to sue) each of the Released Parties (defined below) with respect to any and all claims that you or any of your Related Persons may have (or hereafter accrue) against any of the Released Parties and that relate in any way to (i) your exposure to COVID-19; (ii) your entry into, or presence within or around, the Event (including all risks related thereto, and including without limitation in parking areas or entry gates) or compliance with any protocols applicable to the Event; or (iii) any interaction between you and any personnel of any of the Released Parties present at the Event, in each case whether caused by any action, inaction or negligence of any Released Party or otherwise.
As used herein:
"Related Persons" means your heirs, assigns, executors, administrators, next of kin, anyone attending the Event with you (which persons you represent have authorized you to act on their behalf for purposes of these Supplemental Terms), and other persons acting or purporting to act on your or their behalf.
"Released Parties" means (i) Josh Merideth, (ii) Original Makers Club, (iii) Makers-House, (iv) Makers-Agency, (v) Omni Hotel Louisville, (vi) Omni Hotels & Resorts, (vii) and any of their respective direct and indirect affiliates, administrators, designees, licensees, agents, owners, officers, directors, employees, contractors (and all employees of such contractors) and other personnel; (iii) the direct and indirect owners, lessees and sublessees of the event or at which the Event is held and (vii) all third parties performing services at the Stadium; and (v) any parents, subsidiaries, affiliated and related companies or sponsors and officers, directors, owners, members, managers, partners, employers, employees, agents, contractors, sub-contractors, insurers, representatives, successors and/or assigns of each of the foregoing entities and persons, whether past, present or future and whether in their institutional or personal capacities.
If any provision or part of these Supplemental Terms is held to be illegal, unenforceable, or ineffective, such provision or part thereof shall be deemed modified to the least extent necessary to render such provision legal, enforceable, and effective, or, if no such modification is possible, such provision or part thereof shall be deemed severable, such that all other provisions in and referenced in these Supplemental Terms remain valid and binding.
